Any number of crimes may be placed in this category, but the ones most often seen are:
- Aggravated Assault with a Deadly Weapon
- Aggravated Robbery and Robbery
- Burglary of a Habitation
- Burglary of a Building and Aggravated Kidnappin
These cases are extremely fact dependent and the defenses encompass a wide range—from alibi, to self-defense to necessity.
There are also many ways to attack the lack of proper law enforcement investigation in these cases. For example, on a case of Aggravated Assault, oftentimes at night, the on-call detective may not wind up going out to the scene. So the scene gets processed by the less experienced patrol officers. There may be additional investigation later by a detective, but much evidence that would have been at the scene is now gone. We seize upon this to show how unfair it would be to the client to be convicted upon this type of shoddy evidence.
Sometimes these cases involve clients with long criminal histories. However, that does not mean the client committed this crime. Often a police officer on-scene will run the client’s criminal history and see a lot in his background and then declare he is “good for it,” meaning he has the proper background to be guilty of this case as well. We fight that stigma and show all the holes in the instant case to help demonstrate why the client is not guilty of this case.
